1. IDENTIFICATION OF THE STORE OWNER
These provisions govern the service of “Ecom7 Limited” for the sale of products through its websites, with registered office at Room 1501, Prosperity Tower 39, Queen’s Road Central, Hong Kong, and company number 71402609.
These Terms and Conditions are the only terms applicable to the purchase of products through this online store and replace any others, unless expressly agreed otherwise in writing by the Seller. These Terms and Conditions are important both for you and for the Seller, as they are designed to create a legally binding agreement that protects your rights as a customer and the rights of the Seller as a business. By placing your order, you declare that you have read and unreservedly accept these Terms and Conditions.
These General Conditions may be modified or supplemented by Special Conditions applicable to the purchase of specific products. In the event of a conflict, the provisions of the Special Conditions shall prevail.
2. MODES OF SALE
2.1 Sale of products by Ecom7 Limited directly
Through our Portal you may purchase products marketed directly by Ecom7 Limited. In this case, we will act as the direct seller of the products, and your purchase will be subject to these Terms and Conditions of sale. Once you place an order, we will send you a confirmation of receipt and provide you with information regarding the shipment of the products. In our Portal we only sell products in quantities normally intended for personal consumption, and orders in excessive quantities will not be processed.
2.2 Sale of ebooks or digital content
Through our Portals you may purchase digital content, such as ebooks. The process for marketing such content may vary depending on the specific conditions indicated during the purchase process in each sales website. In general, you must select the digital content you wish to acquire, add it to your shopping cart, and then proceed with payment.
At that point, a checkbox will appear in which you will accept that “by checking this box you agree that once payment is made, the digital content will be downloaded immediately and you will lose your right of withdrawal.” After the download, you will also receive an email with all the digital content purchased and downloaded for your records.
In relation to the right of withdrawal for this type of product, the email sent to you will again remind you of the loss of the right of withdrawal under the terms set out in Clause 6.3.2.

3. ORDERS AND METHOD OF PAYMENT
By placing an order through our Portal, you agree that:

You may only use this Portal to place legally valid orders.

You may not place any false or fraudulent orders. If we have reasonable grounds to believe that such an order has been placed, we will be authorized to cancel it and inform the relevant authorities.

You undertake to provide us with your email address, postal address, and/or other contact details truthfully and correctly and consent that we may use this information to contact you if necessary (see our Privacy Policy). Please note that if you do not provide all the information we require, we will not be able to process your order correctly and delivery may be delayed.

You guarantee that you are over 18 years of age and have the legal capacity to enter into binding contracts.
You will always have access to all the information and forms detailed below through our Portal.
3.1 Delivery period
The delivery period for products shall be a maximum of 30 calendar days from the conclusion of the contract.
If the delivery period for your order exceeds the timeframe indicated in this clause, you may contact us directly by completing the form located under the “Delivery Period” section within the FAQs of the Portal, and we will contact you to provide an appropriate solution.
If your order has been processed, you will be able to obtain the tracking number by entering your order code and the email address used to place the order.
If, for any reason, we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to continue with the purchase by setting a new delivery date or cancel the order with a full refund of the amount paid.
3.2 Shipment tracking
Within an estimated period of 48–72 hours from the day you place your order, you will receive an email with the tracking information for your order.
If your order has been processed, you can obtain the tracking number by entering your order code and the email used for purchase in the “Track your order” form available in the FAQs section of the Portal.
The transport provider may take between 3 and 7 days to activate the tracking identifier online. We kindly ask for your patience if it does not appear immediately on their website.
If delivery cannot be completed due to absence at the delivery address, incorrect addresses, or other circumstances, we will contact you to provide the necessary information so you can arrange collection of your order.
3.3 Customs duties
On some occasions, the transport company or customs authorities may require you to pay an additional customs duty for your order. This occurs because customs taxes are randomly applied to orders entering each country and do not depend on us. Therefore, you will be responsible for paying such fees, as Ecom7 Limited does not assume these costs.
However, should this happen, we recommend that you pay the invoice and then contact us directly through the “Customs Duty” form within the FAQs of the Portal, attaching proof of payment, so that Ecom7 Limited can do everything possible to relieve you of this expense.
3.4 Methods of payment
All orders are placed online through our purchase websites in the Portal. The accepted payment methods will be displayed on the website during the purchase process.
When making payment, you must bear in mind the following:

Provide a single phone number with all digits together, without spaces or dashes.

Complete all fields of the shipping address. If any field cannot be filled, please repeat your city or country.

Ensure that the payment method used has sufficient funds, is enabled for online purchases, that the currency is accepted, and that you have correctly entered the card’s CSV code (normally found on the back of the card).
4. PRODUCTS
4.1 Product information
Under no circumstances is Ecom7 Limited the manufacturer of the products sold on the Portal. Although we strive to ensure the information on our Portal is correct, in some cases packaging and product materials may contain different or additional information, and components or product characteristics may change.
For this reason, we recommend that you do not rely solely on the information available on our Portal and that you carefully read the instructions and manuals included with the product before use.
4.2 Withdrawal of products
We reserve the right to withdraw any product from any of Ecom7 Limited’s purchase websites and/or remove or modify any material or content at any time. We shall not be liable to you or to any third party for the withdrawal of any product, or the removal or modification of any material or content from the Portal.
5. GEOGRAPHICAL SCOPE
The items offered through this website will be available in all those countries where the website is accessible.
6. RIGHT OF WITHDRAWAL
6.1 Order processing and requests for cancellation/modification
Due to the high efficiency of our logistics systems, orders begin to be processed immediately after purchase is completed. For this reason, it is generally not possible to cancel or modify an order once it has been placed.
We recommend that you review your order carefully before finalizing your purchase. If you need urgent assistance, you can consult the FAQs section of our Portal, where you will find the forms and resources available to contact our customer service team.
6.2 Right of withdrawal
In general, and pursuant to Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (General Law on Consumers and Users), consumers and users have the right to withdraw from purchases made at a distance.
To this end, and in accordance with applicable law, you may return the product and cancel the contract entered into between us, without the need to justify such decision and without penalty of any kind, within 14 calendar days from receipt of the purchased products or from the moment of contracting the Additional Commercial Guarantee. To exercise this right, you may either send the product directly to us, duly packaged, new, unused, and complete, or send the WITHDRAWAL FORM accessible through the form located in the FAQ section “Return my order” available on any of Ecom7 Limited’s websites and accessible at all times on the Portal.
As a consumer, you will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, or functioning.
Additionally, in order to process your right of withdrawal, you must bear in mind the following:

All products must be returned in their original packaging and condition, in perfect condition and protected, avoiding adhesive elements directly on the product or packaging. Otherwise, and within the limits permitted by applicable law, Ecom7 Limited reserves the right to refuse the return.

You must send the products without undue delay, following our instructions and including the aforementioned document, within a maximum of 14 days from the date on which you communicated your decision to exercise this right.

The transportation costs for returns will be borne by you.

The refund will be processed as soon as possible and within a maximum of 14 calendar days from the date on which you exercised your right of withdrawal. Please note that we may withhold the refund until we have received the products or until you have provided proof of their return, whichever occurs first.
6.3.1 General exceptions to the right of withdrawal
The right of withdrawal shall not apply to the following contracts, pursuant to Article 103 of the General Law on Consumers and Users:

The provision of services, once the service has been fully performed, when performance has begun with the prior express consent of the consumer and acknowledgment that they are aware that, once the contract has been fully performed, they will lose their right of withdrawal.

The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the entrepreneur.
-
The supply of goods made to the consumer’s specifications or clearly personalized.
-
The supply of goods which are liable to deteriorate or expire rapidly.
-
The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
-
The supply of goods which, after delivery and by their nature, are inseparably mixed with other goods.
-
The supply of alcoholic beverages whose price has been agreed at the time of conclusion of the sales contract, where delivery cannot take place before 30 days and whose actual value depends on fluctuations in the market beyond the control of the entrepreneur.

Contracts where the consumer has specifically requested a visit from the entrepreneur for urgent repair or maintenance work; if, during such a visit, the entrepreneur provides additional services other than those specifically requested or supplies goods other than spare parts necessary to carry out the maintenance or repair work, the right of withdrawal should apply to those additional services or goods.

The supply of sealed audio or video recordings or sealed computer software which were unsealed after delivery by the consumer.
-
The supply of newspapers, periodicals, or magazines, with the exception of subscription contracts for the supply of such publications.
-
Contracts concluded at a public auction.
-
The supply of accommodation services for purposes other than as a dwelling, transport of goods, car rental, catering, or services related to leisure activities, if the contracts provide for a specific date or period of performance.
-
The supply of digital content which is not supplied on a tangible medium, when performance has begun with the prior express consent of the consumer and acknowledgment that they thereby lose their right of withdrawal.
For clarification purposes: the execution of a service (such as delivery) or the acquisition of digital content shall be deemed performed when we first provide you access to the service or content, which will take place immediately after purchase.
6.3.2 Right of withdrawal for “ebook” or “digital content” products
When you purchase an ebook or other digital content from our Portal, once the “download” has started, you agree that this constitutes your request for immediate performance of the service and you acknowledge that this implies the loss of your legal right of withdrawal in relation to the digital content, as set out in Clause 3.2 of these Terms and Conditions.
This is confirmed by accepting the checkbox regarding the loss of the right of withdrawal and, once payment is completed, the download/delivery of your digital content begins. You will also be informed in the confirmation email sent to you after the download has been completed.
6.3.3 Withdrawal from the additional premium transport protection service
As this is an Additional Transport Protection Service, if you exercise the right of withdrawal, part of the service may already have been effectively performed.
Therefore, if performance of the service began before your request for withdrawal, you will only be entitled to a refund proportional to the services you have effectively received. For example, if you received the service for three days prior to your withdrawal request, you will be entitled to a refund for the full coverage of the service, less the cost corresponding to the three days of service received. Your refund will be made in accordance with these terms and conditions. No commission will be charged as a result of this refund.
For this reason, at the time you contract the Additional Premium Transport Protection Service you will be specifically informed of this condition, and you will also be informed again in the confirmation email sent to you after purchasing the product(s).
7. WARRANTY FOR PRODUCTS AND ADDITIONAL SERVICES
Ecom7 Limited offers a legal warranty service in accordance with applicable law. In addition, we offer you the possibility of purchasing an additional warranty service (legally a commercial warranty) as set out below.
7.1 What is the legal warranty?
Liability for lack of conformity of the product shall be governed by Articles 114 and following of Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users.
This is the warranty on the sale of consumer goods established by European Directive 2019/771, also known as the “conformity guarantee,” which protects consumers when purchased products are not in conformity with the sales contract (i.e., the products do not work properly from the outset, do not match the description or characteristics provided by the seller, are not suitable for their intended ordinary use, or cannot be used in accordance with the performance described by the seller).
The legal warranty only applies to consumers, meaning those who purchase products for non-professional use. Therefore, as a consumer, you are entitled to claim the legal warranty from the seller of the product, even if the seller is not the manufacturer.
7.1.1 Rights granted under the legal warranty
If the product you purchased has a defect covered by the legal warranty, you have the right to demand from the seller the repair or replacement of the defective product, free of charge. You also have the right to a price reduction or to terminate the contract in the following cases:
(a) if repair or replacement is not possible or is excessively costly;
(b) if the seller does not repair or replace the product within a reasonable time; or
(c) if repair or replacement causes you significant inconvenience.
However, this does not mean that a minor defect which prevents repair or replacement of the purchased products, or which makes them very costly, automatically entitles you to terminate this contract.
7.1.2 Duration of the legal warranty and enforcement by the consumer
The products offered by Ecom7 Limited are covered by the legal warranty of three (3) years from delivery for new products sold by the seller, in accordance with consumer protection laws. To make use of this warranty, you must notify the seller of the defect within two months from the date you discovered it.
During the first two (2) years from delivery, it is presumed that any lack of conformity already existed at the time of delivery, unless proven otherwise.
The legal warranty for products sold directly by Ecom7 Limited is provided by Ecom7 Limited.
Ecom7 Limited will assist you at all times, through its customer service, in managing any warranty applicable to purchased products.
7.2 Additional commercial warranty (“ACW”)
Ecom7 Limited offers users, during the purchase process, the possibility of contracting an additional commercial warranty. This warranty is an optional service that does not affect or limit the Legal Warranty, which will always be free for the user. Under no circumstances does this Additional Commercial Warranty replace or reduce the duration or content of the Legal Warranty in force during the established period.
The ACW may be contracted for a term of one (1) or two (2) years.
7.2.1 Coverage of the ACW
This service will only cover the cost of repair or replacement for damage caused by wear and tear of the product not attributable to improper use. You will be entitled to one replacement or repair of the limited product for each twelve (12) month period, unless that new shipment has not been received or contains damage or defects.
The coverage includes:

Express replacement through accelerated and urgent handling of receipt and shipping processes.
-
Compensation with a similar or superior model from the catalogue in the event of lack of stock of the purchased product.
-
Replacement of worn accessories due to proper use in technological products, watches, or textiles, or replacement of the complete product.
Technological products: accessories or buttons.
Watches: straps, buckles, or buttons.
7.2.2 Exclusions
The following are excluded:
-
Improper use. Manufacturer’s instructions, or in their absence, those of Ecom7 Limited, must be followed and the product must be used reasonably and diligently. Otherwise, the service may be denied or reduced proportionately to the damage caused and the buyer’s degree of fault.
-
Intentional or deliberate damage to the product.
-
Loss, theft, or robbery of the product.
-
In the case of technological products or smartwatches, aesthetic damage (such as scratches, dents, or corrosion) or screen damage not affecting functionality.
-
Accidental damage (drops, impacts, breakages).
-
Damage resulting from intentional or fraudulent acts.
-
Damage from improper use contrary to instructions or technical specifications.
-
Damage caused by malicious software.
-
Product malfunction due to software failure or updates.
-
Accessories or components not included with the product at the time of purchase, or coverage for any accessory damaged that is not compatible with the replaced product.
-
Any failure or cost related to product recall by the manufacturer.
7.3 Additional premium transport protection service
Contracting this additional service is voluntary and is intended solely to improve and expedite shipping and the possible resolution of shipping incidents. Failure to contract this additional service does not limit the scope and content of your rights as a consumer under Royal Legislative Decree 1/2007 and these terms and conditions.
By contracting this service, in addition to the rights granted to you as a consumer by applicable law, Premium Protection Service will include:

Priority handling in resolving your claim status.
-
Preferential support service, with resolution within 48 business hours.
-
Enhanced order tracking with personalized email notifications.
-
Direct management and communication with the transport company, without consumer involvement.
See “Exceptions to the right of withdrawal” applicable to this service in Clause 6.3.3 of these Terms and Conditions.
8. POLICY FOR UNDELIVERED OR UNCLAIMED ORDERS
8.1 Failed deliveries for reasons beyond the seller
If an order cannot be delivered for reasons not attributable to Ecom7 Limited or its suppliers (including, but not limited to, incomplete or incorrect address, repeated absence of the recipient, or failure to collect from the designated pick-up point), we will attempt to contact the customer using the details provided during purchase (email, telephone, or instant messaging). If contact is successful, an alternative solution will be proposed.
8.2 Inactivity or lack of response from the customer
If, after thirty (30) calendar days from the first attempt at notification, no response is received from the customer, the order will be considered closed due to abandonment by the customer, without giving rise to any right to a refund or automatic reshipment of the product.
8.3 Storage of the product
The order will be stored in the supplier’s or Seller’s logistics facilities for a maximum of ninety (90) calendar days from the first delivery attempt. After this period, if the customer has not managed their claim or expressly requested delivery or refund, it will be understood that they have waived it. Consequently, the order may be destroyed or allocated to other logistical purposes without any right to compensation, refund, or reshipment.
8.4 Subsequent claims
The customer may exercise their right to file a claim. However, if the delay or abandonment of the order is attributable to the customer’s inactivity, the Seller will assess the claim on a case-by-case basis, reserving the right to deny a refund or reshipment if no justified cause exists.
9. LIABILITY
In cases where the Customer acts as a consumer, both this clause and the others set out in these conditions shall be limited by the provisions of the General Law on Consumers and Users, meaning consumer rights and guarantees shall prevail over any provision that may be interpreted to the contrary.
Therefore, within the limits permitted by applicable law, Ecom7 Limited shall not be liable for:
(i) losses not attributable to any breach on our part,
(ii) business losses (including lost profits or revenue), or
(iii) any indirect or consequential losses not reasonably foreseeable by both parties at the time these general conditions were formalized in relation to the purchase of products between us.
Please note that the law in some countries may not allow some or all of the liability limitations set forth in this clause, and therefore some of these limitations may not apply to you. Conversely, such laws may also grant you additional rights beyond those provided here.
Nothing in these conditions limits or excludes Ecom7 Limited’s liability for death or personal injury caused by our negligence or willful misconduct.
Please note that Ecom7 Limited cannot assume responsibility for any failure or non-fulfilment of its obligations arising under these conditions if such failure is due to circumstances beyond our reasonable control. Of course, this does not affect your right to receive products within a reasonable time.
The risks of the Products shall be borne by you from the moment of delivery. For the purposes of these Conditions, delivery shall be deemed to have occurred when the product has been physically delivered to you and you have acquired material possession, either by Ecom7 Limited or by a third party.
10. PRICE
The price of the products shall be the final price stipulated at any given time on the various Ecom7 Limited portals.
The prices on the websites include taxes. Shipping costs will be charged according to the options you selected during the purchasing process. The payment methods available in our Portal are those commonly used for e-commerce and will in any case be displayed at the time of completing the purchase process.
You agree to receive invoices for your purchases electronically. Electronic invoices will be provided in PDF format.
11. WRITTEN COMMUNICATIONS
Applicable regulations require that certain communications or information we send you must be in writing. Accordingly, you agree that we may communicate with you by electronic means, either via email or SMS, and by posting notices on our Portal.
For contractual purposes, you agree that all contracts, notices, information, and other communications provided to you electronically comply with any legal requirement that such communications be made in writing. This condition does not affect your statutory rights.
12. OUR RIGHT TO MODIFY THESE CONDITIONS
Ecom7 reserves the right to review and amend these conditions at any time. In any case, you will be subject to the conditions in force at the time you place each order.

14. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong.
The parties expressly waive any other jurisdiction that may correspond to them and irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any dispute or claim arising out of or relating to the interpretation or performance of these contractual conditions.
